1. Who we are

This website is operated by BMFIE Limited, trading as Bad Faith. We are registered in England and Wales under company number 17279775. Our registered office is 10 Ashburnham Mews, London, England, SW1P 4FH.

These terms apply to every order placed through this website. By placing an order you accept them. Please read them before you buy.

2. Age of sale

We sell tobacco products. It is illegal for us to sell them to anyone under 18.

From 1 January 2027, under the Tobacco and Vapes Act 2026, it is illegal for us to sell tobacco products to anyone born on or after 1 January 2009. From that date our age check asks for your date of birth rather than a declaration.

By placing an order you confirm that you are old enough to buy tobacco under the law as it stands on the day you order, and that the person receiving the parcel is too.

Age is checked twice: once on this website before you can shop, and again on delivery. Our courier will not hand over a parcel unless an adult aged 18 or over is present to receive it, and may ask for photographic identification. If age cannot be verified, the parcel is returned to us and your order is cancelled and refunded in full.

3. Where we deliver

We deliver to Great Britain only, meaning England, Scotland and Wales. We do not deliver to Northern Ireland, the Channel Islands, the Isle of Man, BFPO addresses, or any address outside the United Kingdom. Orders placed for delivery to an address we do not serve will be cancelled and refunded in full.

4. What we sell

We sell one cigar: Free Agent, a Gran Robusto measuring 55 ring gauge by 5½ inches. Direct from this website it is sold in bundles of ten. It is not sold here as a single stick.

Free Agent is a handmade product made from a natural leaf. Individual cigars vary in colour, veining and appearance. That variation is normal and is not a fault.

Run one is limited to 10,000 cigars. When they are gone, that run is finished and will not be repeated. Any future run is a separate release and is not part of run one.

5. Placing an order

Your order is an offer to buy. A contract is formed only when we send you an email confirming that your order has been dispatched.

Until then we may decline or cancel your order, for example if age verification fails, if the delivery address is outside the area we serve, if we suspect fraud, or if the item is no longer available. If we do, we refund you in full and you owe us nothing.

We do not sell for resale. We may refuse or limit orders that appear to be for commercial resale.

6. Prices and payment

Prices are shown in pounds sterling and include UK tobacco duty. Any VAT payable and the cost of delivery are shown at checkout before you pay.

Payment is taken at checkout by our payment provider. We do not see or store your full card details.

We try to keep pricing accurate. If we find an error in the price of something you have ordered, we will contact you before dispatch and you can confirm the order at the correct price or cancel it for a full refund.

7. Returns

You have 14 days from delivery to change your mind, and separate rights if the goods are faulty. Both are set out in full in our Return and refund policy, which forms part of these terms.

8. Membership

Membership of Bad Faith is by invitation only. It cannot be bought through this website. Where membership is offered, its terms are set out in the invitation itself and stand alongside, not instead of, these terms.

9. Our brand and this website

Bad Faith, Free Agent, the magpie mark, and the text, images and design of this website belong to BMFIE Limited or are used under licence. You may not copy or reuse them without our written permission.

10. Our liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

Subject to that, our total liability to you for any order is limited to the amount you paid for it. We are not liable for business losses; these terms cover sales to consumers.

Smoking damages health. Nothing on this website suggests otherwise.

11. Complaints

Email t@badfaithcigars.com or call 07884077754. We will acknowledge your complaint within five working days and aim to resolve it within 28 days.

12. Changes to these terms

We may change these terms. The version in force when you place your order is the version that applies to that order.

13. Governing law

These terms are governed by the law of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Wales you may also bring proceedings in your own jurisdiction.
